A posting is a temporary work assignment abroad in which employees work for their employer in another country. In contrast to workation, the posting is typically business-related and can trigger obligations regarding A1 certificate, posting notification, social security, labor law, tax and immigration.

Definition

A posting occurs when an employer temporarily sends employees to another country to work there. The deployment can take place at a group company, a customer, on a construction site, in a project or at another company location. Essentially, the person remains employed by the sending employer, but temporarily works outside the country of normal employment.

Assignment is not the same as a short business trip and also not the same as home office abroad. The distinction depends on the purpose, duration, activity, target country and organizational integration.

Why posting is relevant for employers

Assignments can trigger multiple areas of compliance at the same time. HR not only has to record travel and assignment data, but also check which reports, evidence and local requirements are necessary before the start of the assignment abroad. The connection to the A1 certificate and to social security agreement is particularly important.

Typical obligations and risks are:

  • Proof of social security, especially A1 or comparable certificate
  • Posting notification or posting notification in the destination country
  • local minimum working conditions and labor protection regulations
