An employer of record, or EOR for short, is a local legal entity or service provider that formally acts as an employer. The using company usually controls the daily work, while the EOR takes care of local payroll, employment contract, employer registration and administrative compliance.
Definition
An EOR model can make sense if a company wants to permanently employ employees in a country without immediately setting up its own local unit. It is therefore a structural employment model and not a shortcut for spontaneous workation or short home office abroad requests.
When an EOR is appropriate
An EOR can be of interest to employers if:
- a person lives permanently in another country
- a market is tested before setting up your own company
- a local employment contract is required
- Local payroll and employer registration are required
- the employment is planned for the long term rather than just temporarily
For short cases of work abroad, however, a Remote Work Compliance check is often more obvious.
Limits and risks
Even with EOR, questions remain unanswered: Who controls the work? Do co-employment or permanent establishment risks arise? Is a work permit necessary? How are data protection, IP, performance management, termination and travel to additional countries regulated?
EOR also does not replace a digital nomad visa and does not automatically resolve all tax or immigration issues.
