ESTA stands for Electronic System for Travel Authorization and is relevant for many business trips to the USA. Employees from certain countries can travel with ESTA under the US Visa Waiver Program if the requirements are met. For employers in the DACH region and the EU, ESTA is a frequent checkpoint, especially for short-term trips to the USA, meetings, conferences and internal coordination.

It is important to differentiate: ESTA is not a general work permit. It enables travel under the Visa Waiver Program, but does not replace a visa if the planned activity does not fall under it. Anyone who works productively in the USA, is deployed locally or carries out activities outside the permitted visitor framework may need a different procedure.

Definition

ESTA is an electronic travel authorization for eligible travelers who wish to travel to the United States under the US Visa Waiver Program. The authorization is linked to the passport and is requested before travel. An ESTA approval does not automatically mean that entry is definitely permitted; the final decision is made at the border.

ESTA should be distinguished from a business travel visa, tourist visa, ETA and work permit. Each document answers a different travel or work authorization question.

  • Is the person eligible for the Visa Waiver Program?
  • Is the passport valid and suitable?
  • Is the purpose of the trip business, tourist or work-related?

  • Do you work productively on site or just take part in meetings?
  • Is a business travel visa or other status required?

This check should be part of the International Travel Compliance and not just when booking the trip.

Important distinctions

ESTA is country-specific for the USA. An ETA is a more general term for electronic travel authorizations from other countries, for example UK ETA or Canada eTA. A business travel visa is a visa category for specific countries and travel purposes. A work permit concerns work authorization and should not be confused with ESTA.
